Notice Regarding Voided Bi-Monthly Samples from July and August



Some of you may have received, or may receive, notification that your respirable dust samples collected for the July and August bi-monthly sampling period are being voided. Most are voided as excess samples (EXC). Over a one-month period prior to the effective date of the new respirable dust final rule (July 2014), MSHA is making necessary changes to the Agency's computer system to conform to the new final rule. During this period, the voided samples with the EXC code do not require additional sampling. During this transition period, MSHA will evaluate operator samples to determine if follow-up action is necessary. MSHA inspector samples, operator samples taken for abatement and Part 90 samples are not affected and continue to be processed. Under the final rule, the operators' bimonthly sampling resumes September-October 2014.
