SUBJECT:      Revalidation and Cancellation of MSHA Program Directives

Scope

This Program Information Bulletin (PIB) is for all MSHA program directives holders within MSHA, mine operators, independent contractors, miners' representatives, and other interested parties.

Purpose

The purpose of this PIB is to provide the results of the annual revalidation process and a list of policies and procedures that will be cancelled upon publication of this PIB.

Information

MSHA's revalidation process dictates that all directives must be reviewed annually or biennially to ensure the currency of their contents. This PIB provides the results of the Program Policy Letters' (PPLs'), Program Instruction Letters' (PILs'), and Program Information Bulletins' (PIBs') revalidation for Calendar Year 2020.

The attachment lists those PPLs, PILs, and PIBs that have been identified for cancellation during the review. They are no longer considered valid enforcement guidance and will be cancelled and removed from the MSHA website upon the issue of this bulletin.

Directives pages on the MSHA Internet continue to be the most up-to-date resource for in-force directives. All PPLs, PILs, and PIBs that remain posted on the MSHA website have an expiration date of March 31, 2021.


Background

Volume II, Chapter 100 of MSHA's Administrative Policy and Procedures Manual outlines MSHA Directives System and defines the purpose, responsibilities, structure, and procedures involved in the formulation, distribution, and maintenance of directives within the Agency. The Directives System also describes the procedures for assigning expiration dates to PPLs and PILs, as well as the procedures for periodical reviews and updates to directives.

Authority

The Federal Mine Safety and Health Act of 1977 [30 U.S.C. 801 et seq.] as amended by the Mine Improvement and New Emergency Response Act of 2006 ("MINER Act") [Pub. L. 109-236].
